港鐵高鐵工程合約

港鐵近日完成了高鐵西九龍總站土木工程的 Contract MTRC 810A 招標，

消息指，入標的承建商的標價差距極大。

最低標價是前田建設、大林組、中國建築聯營公司，標價為 76.7億元。

第二低標是寶嘉、協興建築聯營公司，標價為 81.3億元。

禮頓、金門建築聯營公司標價較高，為 89.1億元 (should be the biggest single Civil contract in HK so far, correct me if I am wrong here)。

標價全部都比政府估計的成本 94.54億元，低 6%至 19%。

消息又指，港鐵日內正式批出西九龍總站土木工程合約，last week, 港鐵 already 批予標價較高的禮頓、金門建築聯營公司，令高鐵未能大幅節省 10多億元工程成本。

If 禮頓、金門 JV sublet this contract to 寶嘉、協興 or 前田建設、大林組、中國,  

禮頓、金門 JV, simply arranging a few guy as a management for doing co-ordination, and then could earn a windfall of profit without any need to do the work

嗰時個PTE應該無預到依家個CPF高左咁多，落標咁底實會出問題

Awarded contract sum is not equal to the final contract sum.

But it seems to be within the budget.

可能諗住都係玩claims...攞盡contingency.....不過如果要claim 到increase in contract sum就麻煩

I learnt this 西鐵西門子事件 case in a seminar held by Hong Kong International Arbitration centre in the past.   The key element was that there was no any alternative competent signalling contractor who could effectively take up Siemems' work if KCRC kicked away Siemen.   Since the commencement of dispute, KCRC would like to sublet the remaining works to a singaporean company.  Yet, KCRC was indicated not to take risk and just concede in the matter with Siemens eventually.

That's why KCRC agreed by a "Supplementary Agreement" to Siemems for recovering all the additional costs which were not included in the orginal contract.

Supplementary Agreement 補充協議

Oh I see is SA which would be introduced if the contractor is ordered to carry out any works outside the agreed scope of works and such additional works is estimated to cost more than 50% of the original contract sum!

But personally, if the contractor really fail to deliver as agreed in terms of workmanship or progress, I prefer to remove the contractor and allow re- enter.... But of course, it will take more time to find a new contractor through the normal tendering procedure
