香港的法律制度大致沿襲自殖民地時期的宗主國英國。1997年主權移交後，《基本法》開始實施，是香港作為特別行政區法律制度的憲制性文件。根據一國兩制的原則，香港的法律制度得以繼續以普通法為依歸，並由多條本地法例作補充。因此，香港的法律制度與中華人民共和國大陸地區的制度截然不同。
香港目前實施的法律包括：

• 《中華人民共和國憲法》；
• 《香港特別行政區基本法》；
• 《香港特別行政區基本法》附件三載列的中國全國性法律；
• 香港主權移交前的原有法律，經中國全國人民代表大會常務委員會通過採納為香港特區法律者；及
• 香港特區立法機關制定的成文法律。
• 普通法
• 衡平法

與國防、外交及其他在香港特別行政區自治範圍以外的事務有關的全國性法律，可以由香港特區公布或自行立法，在香港施行。目前有12條中國全國性法律適用於香港特區。

The law of Hong Kong is based on the rule of law and the independence of the Judiciary. The constitutional framework for the legal system is provided by the Hong Kong Basic Law. Under the principle of ‘one country, two systems’, the legal framework of Hong Kong is based on the English common law, supplemented by local legislation. As a special administrative region, the Hong Kong legal system is significantly different from the legal system in mainland China. However, a small number of national laws, such as those involving national emblems and symbols, apply in Hong Kong.[1] The separation of the Hong Kong legal system to the rest of the PRC is guaranteed constitutionally until at least 2047.
The legal system in Hong Kong is therefore similar to the common law systems used in England and Wales and other Commonwealth countries. In contrast, the legal system of Mainland China is akin to those in Continental Europe and the French-speaking Canadian province of Québec (Code civil du Québec). The Hong Kong judiciary has had a long reputation for its fairness.
